Terms and Conditions

The Services are intended for users who are at least 13 years of age. If you are a minor in your jurisdiction, you may use the Services only with permission from, and under the supervision of, a parent or guardian.

You are responsible for providing accurate account information and keeping your account secure. You may need an account to use parts of the Service. You may not create an account using someone else's identity, email, community handle, business name, image, or other identifying information without permission.

You are responsible for activity under your account unless caused by our failure to use reasonable security measures. You must not share your password or attempt to access another user's account, bypass access controls, scrape the Service, interfere with security, or access internal or non-public systems without authorization.

Plantivision provides plant care, plant tracking, reminders, photo uploads, Viz AI assistance, community features, marketplace features, messaging, support, and related services. The Services are not intended for distribution or use where such distribution or use would violate law or require registration that we have not obtained.

The Services are not tailored to comply with industry-specific regulations such as HIPAA, FISMA, or GLBA. Do not use the Services in a way that would subject Plantivision to those laws or similar regulated obligations.

Plantivision and its licensors own the Services, including software, source code, databases, designs, workflows, text, graphics, trademarks, logos, catalog structure, prompts, AI integrations, and other content, excluding user content and third-party materials.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use.

You may not copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit, distribute, sell, license, reverse engineer, or otherwise exploit the Services or our content except as permitted by law or by us in writing.

If you submit ideas, suggestions, bug reports, or feedback, you agree that we may use them without restriction or compensation.

Plantivision may offer paid features, premium Viz access, subscriptions, free trials, usage-based features, seller tools, marketplace promotion, or other paid products. Availability may vary by platform, region, release, and account.

We accept payments through Apple Pay, Google Pay, and payment methods supported by the applicable app store or payment provider. Payments are made in the local currency presented by Apple App Store or Google Play, depending on your region.

Subscriptions may renew automatically unless canceled before renewal. We may offer a seven (7) day free trial to new users; when the trial ends, the selected subscription may be charged according to the applicable purchase flow.

Subscriptions, purchases, refunds, cancellations, renewals, and billing issues for mobile app purchases are handled through the applicable app store. You must manage subscriptions and refund requests through Apple App Store or Google Play according to their respective policies. Deleting the app or your Plantivision account may not cancel a subscription.

We may change pricing or paid feature terms with notice where required. If you do not agree to a fee change, cancel before the change takes effect.

You may not access or use the Services for any purpose other than those for which we make the Services available.

• Systematically retrieve data or compile directories, databases, or collections from the Services without written permission.
• Trick, defraud, mislead, harass, threaten, spam, scam, impersonate, or attempt to defraud us or other users.
• Interfere with security-related features, bypass access restrictions, upload malware, overload systems, scrape, mine data, or use bots, scripts, or other automated tools.
• Sell or otherwise transfer your profile.
• List, sell, trade, or offer items that are illegal, unsafe, stolen, counterfeit, regulated, recalled, hazardous, or otherwise prohibited by applicable law.
• Use the marketplace to sell animals, weapons, drugs, controlled substances, pesticides or chemicals requiring special licensing, or any item requiring permits you do not hold.
• Misrepresent listings, prices, availability, item condition, pickup location, identity, ownership, or the nature of any plant, produce, or related item.
• Use Plantivision's AI features as a substitute for professional agricultural, medical, legal, safety, or emergency advice.
• Upload or share content that infringes intellectual property rights, violates privacy rights, or contains unlawful, harmful, hateful, explicit, deceptive, invasive, or abusive material.
• Collect or publish another person's personal information without permission.
• Use the Services in a way that violates applicable law or competes with Plantivision through unauthorized use of our Services or content.

"User Content" means content or data you submit, upload, create, send, or display through the Services, including profiles, photos, plant notes, care logs, community posts, comments, marketplace listings, messages, ratings, reviews, reports, Viz prompts, and feedback.

You retain ownership of your User Content. You grant Plantivision a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, copy, modify, display, transmit, analyze, and otherwise use your User Content as needed to operate, provide, secure, improve, support, moderate, and promote the Services, comply with law, and enforce these Terms.

You represent that you have the rights needed to submit your User Content and that it does not violate law, these Terms, or another person's rights. Reviews and ratings must be truthful, based on actual interactions, and must not be abusive, discriminatory, misleading, or part of a campaign to manipulate ratings.

Plantivision may remove content, restrict features, suspend accounts, or take other action when content or behavior violates these Terms, applicable law, or platform safety rules. Some content may remain after deletion where it has been shared with others, detached from your account, retained for legal or safety reasons, included in backups or logs, or needed for transaction or conversation integrity.

If you access the Services through the App, we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on devices you own or control, strictly in accordance with these Terms.

You must comply with Apple App Store and Google Play terms when using the App. Apple and Google may be third-party beneficiaries of these Terms as they relate to the App and may enforce those terms against you.

Plantivision may provide AI-generated plant care, identification, diagnosis, planning, and marketplace-related assistance. AI outputs may be incomplete, inaccurate, outdated, misleading, or unsuitable for your specific circumstances.

You are responsible for independently evaluating AI outputs before relying on them. Plantivision does not provide professional agricultural, medical, veterinary, legal, financial, safety, toxicology, emergency, or regulated advice.

Plantivision provides marketplace features where users may create seller profiles, list plants or related goods, browse listings, save listings, message users, submit ratings, report content, and block users.

Marketplace listings, messages, transactions, pickup arrangements, prices, item quality, legality, safety, and fulfillment are the responsibility of the users involved. Plantivision is not a party to user-to-user marketplace transactions and does not guarantee listings, sellers, buyers, items, payments, pickup arrangements, or transaction outcomes.

You are responsible for your listings, communications, pricing, pickup or delivery arrangements, transaction decisions, taxes, and legal compliance, including laws related to plants, seeds, produce, food, honey, nursery stock, pesticides, soil, invasive species, quarantine, labeling, weights and measures, and local commerce.

Users must interact respectfully and may not harass, threaten, abuse, stalk, impersonate, spam, scam, exploit, discriminate against, or otherwise harm other users. Users may not post or send unlawful, hateful, violent, sexually explicit, deceptive, invasive, or abusive content.

Community features may allow users to post, comment, reply, like, follow, mention, tag, report, block, and share photos. You are responsible for your interactions with other users online and offline. Plantivision is not responsible for user conduct or user-generated content.

Plantivision may remove content, restrict features, suspend accounts, or terminate accounts when user conduct violates these Terms, applicable law, community safety expectations, or the rights and safety of others.

The Services support image uploads for plant profiles, care events, avatars, seller profiles, marketplace listings and messages, community content, Viz, and catalog content. Do not upload images unless you have the right to do so.

Some features use location information. Marketplace listings, seller profiles, community posts, and Viz may use location when you provide it or grant permission. Do not publish precise location information unless you are comfortable sharing it with users who can view the relevant content.

We may send in-app notifications, push notifications, WebSocket updates, care reminders, marketplace message updates, community updates, password reset emails, support messages, and legal or service notices. Delivery is not guaranteed.

We care about data privacy and security. Please review our Privacy Policy at https://plantivision.com/privacy. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Terms.

The Services are hosted in the United States and Canada. If you access the Services from another region, you understand that your information may be transferred to and processed in the United States and Canada.

We maintain certain data to operate the Services. Although we perform routine backups, you are responsible for data you transmit. We are not liable for loss or corruption of user data except where liability cannot be limited by law.

The Service may rely on or link to third-party services, including app stores, payment providers, Google Cloud, Google AI services, Google Places, Expo, APNs, FCM, Resend, Cloudflare Turnstile, Google Analytics, and others.

Third-party services are governed by their own terms and privacy policies. Plantivision is not responsible for third-party content, policies, outages, billing, refunds, data processing, or services. If advertisers appear in the Services, we provide the space for those advertisements and do not assume responsibility for advertiser claims or offerings.

We respect intellectual property rights. If you believe material available on or through the Services infringes a copyright you own or control, notify us at support@plantivision.com. If you are not sure whether material infringes your copyright, consider contacting an attorney before sending a notice.

We may monitor the Services for violations of these Terms, take legal or safety action where appropriate, remove or restrict content, disable features, suspend accounts, preserve records, report activity, and otherwise manage the Services to protect rights, users, safety, and proper operation.

We may modify, suspend, discontinue, limit, replace, or remove any part of the Services at any time, including features, catalog data, marketplace tools, community features, Viz models, usage limits, credits, pricing, APIs, and storage behavior. We do not guarantee uninterrupted, error-free, secure, or universally available Services.

We may suspend, restrict, or terminate your account or access if we believe you violated these Terms, created legal, safety, security, fraud, or abuse risk, misused marketplace or community features, compromised the Services, or if required by law or platform policy.

These Terms are governed by and defined following the laws of Canada. Plantivision Inc. and you consent that the courts of Canada have exclusive jurisdiction to resolve disputes that may arise in connection with these Terms, except where arbitration applies or mandatory consumer law requires otherwise.

To expedite resolution and control costs, the parties agree to first attempt to negotiate any dispute informally for at least thirty (30) days after written notice.

If the parties cannot resolve the dispute informally, the dispute will be finally resolved by arbitration under the United Nations Commission on International Trade Law Arbitration Rules then in force. The number of arbitrators will be one (1). The seat or legal place of arbitration will be Toronto, Canada. The language of proceedings will be English.

Arbitration will be limited to the dispute between the parties individually. To the fullest extent permitted by law, no dispute may be joined with another proceeding or brought as a class, collective, representative, or private attorney general action. Disputes concerning intellectual property rights, theft, piracy, invasion of privacy, unauthorized use, or injunctive relief may be excluded from arbitration.

The Services are provided "as is" and "as available." To the fullest extent permitted by law, Plantivision disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and reliability.

We do not warrant that content, catalog data, reminders, forecasts, Viz output, marketplace data, pricing data, community content, uploads, messages, notifications, or user interactions will be accurate, reliable, safe, lawful, uninterrupted, or error-free. Your use of the Services is at your sole risk.

To the maximum extent permitted by law, Plantivision and its officers, directors, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, loss of goodwill, crop loss, plant loss, marketplace losses, health effects, personal injury, property damage, business interruption, or other intangible losses arising from or related to the Services.

To the maximum extent permitted by law, Plantivision's total liability for all claims relating to the Services will be limited to the lesser of the amount you paid to us during the six (6) months before the cause of action arose or 100. Some laws do not allow certain limitations, so some limitations may not apply to you.

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Plantivision and its officers, directors, employees, contractors, agents, affiliates, licensors, and service providers from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from or related to your use of the Services, User Content, marketplace activity, community activity, Viz use, violation of these Terms, violation of law, or violation of third-party rights.

Visiting the Services, sending emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that electronic notices, disclosures, agreements, and records satisfy any legal requirement that such communication be in writing.

If a complaint is not satisfactorily resolved, California users and residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs.

We may update these Terms from time to time. If changes are material, we will provide notice by reasonable means, such as in-app notice, website notice, email, or an updated effective date.

Your continued use of the Services after updated Terms take effect means you accept the updated Terms. If you do not agree, stop using the Services.

These Terms and any policies or operating rules posted by us constitute the entire agreement between you and us regarding the Services. If any provision is unlawful, void, or unenforceable, that provision is severable and does not affect the remaining provisions. Our failure to enforce a right is not a waiver. We may assign our rights and obligations. No joint venture, partnership, employment, or agency relationship is created by these Terms.
